Pillway is a brand of Simpill Health Group Inc.
You agree to use the Pillway (A brand of Simpill Health Group Inc.) online experience for lawful purposes only. You agree to use the Pillway services in a way that is not disruptive to other users (spamming, flooding, defacing any part of the Pillway services and other disruptive actions are prohibited). You agree to not use the Pillway services to communicate any unlawful, harmful, offensive, threatening, abusive, defamatory, vulgar, obscene, racist, hateful, sexually explicit, fraudulent content or any material that encourages conduct that would constitute a criminal offense or violate applicable laws.
Users agree to not post or transmit any virus or corrupt code that is potentially harmful and is intended to damage the operation of Simpill Health Group Inc software, hardware or operations.
Placing an order on Pillway
In order to use Pillway services, you must provide accurate, current and complete information about yourself to our authorized Simpill Health Group Inc. pharmacists and personnel. Data we collect can include your and/or patient’s name, age, gender, phone number, email address, shipping address, credit card information (or image of card), insurance information (or image of card) and any other personally-identifiable information required to deliver medication placed through the Pillway App. To serve you better we may also collect optional information such as medical, allergy, and other health related information to share with our pharmacist and healthcare team. We may also gather other non-personally identifiable information such as medication adherence statistics and location data. We only allow access and disclose Personal Information in accordance with the Canadian Personal Health Information Protection Act (PHIPA).
User contacts
You agree to be contacts by authorized Pillway personnel and our licensed pharmacists at the phone number listed in your Pillway profile. You may be contacted for all prescription filling and delivery related purposes. Standard phone rates may apply. By agreeing to the Terms of Use you also agree to receive emails, SMS messages and push notifications directly to your mobile phone via unsecured channels. Standard messaging charges may apply when contacted via mobile phones.
We will contact your via email for notification purposes and to inform you of promotional offers that may be of interest to you. Personal health information (PHI) and financial information will not be communicated via email. You can opt-out of receiving marketing and promotional material at any time and we will take all necessary steps to remove you from the mailing list. We have implemented this set of practices to comply with Canada’s Anti-Spam Legislation (CASL).
Your conduct and eligibility
You must be at least 18 years or older to use the Pillway app and all its related services. A parent or guardian may use Pillway services to request prescriptions for minors and will be held fully responsible. Once a minor turns 18, he/she will be required to re-register with the service as an independent new user.
Accounts and passwords
To use Pillway services, users will be required to create an account that includes setting up a user ID, password and 4 digit pin. You are responsible for keeping this information secure at all times. If at any time you suspect that your account information has been compromised you agree to notify us immediately. Pillway will not be liable for any damages that arise from the failure to secure your personal account information.
Limitation of liability
In no event will Pillway be liable for any decision made or action taken with regards to the information provided via Pillway services. You use any information accessed via the app at your own risk. If you are experiencing a medical emergency contact 911 immediately.
In no event or circumstance will Simpill Health Group Inc, partners or its holding companies be liable for any indirect, punitive, incidental, exemplary or consequential damages that result from the use of, inability to use the, Pillway app and/or Pillway services. These exclusions apply to loss of profits, good will, lost data, any other commercial damages, negligence or malpractice, even if Pillway has been advised of or should have known the possibility of such damages. You assume total responsibility for the use of the App and Pillway services. Your sole remedy against Pillway for any dispute is to stop using the App and the cancellation of all Pillway services.
Indemnification
You agree to hold harmless, defend and indemnify Simpill Health Group Inc., and its subsidiaries, our employees, officers, directors, suppliers, partners, shareholders from and against claims, including any expense arising from losses, damages, suits, litigation costs and attorneys fees, made by any third party that may arise from (a) The breach of the terms of use of our privacy policy, (b) Your use of the app and Pillway services, (c) your violation of laws and regulations, or by our gross negligence or willful misconduct.
Choice of Law and Dispute resolution
The Terms of Use shall be deemed construed, governed and enforced with the laws of the Province of Ontario, Canada, without giving effect to any conflicts of law statutes. Any and all disputes you may have with Simpill Health Group Inc., that cannot be resolved, shall be resolved individually, without resort to any form of class action.
Termination
Pillway reserves the right to suspend or terminate access to your account and the use of Pillway services without notice if it is in violation of these Terms of Use or if it is deemed harmful to Pillway's interests.
